Geocrat Terms of Services

A. General Disclaimer
1. The information on Geocrat Website, Geocrat Applications, and Geocrat Services, hereby referred to as Geocrat Platform' is provided on "as is" basis and Geocrat Technologies Private Limited reserves the right to add, delete or change any of the contents, including content submitted or generated by users, of this Geocrat Platform at any point in time. By making a post, the user has acknowledged and agreed to the fact that any change on the users post, if the user continues to access the Geocrat Platform, is acceptable to the user. Geocrat Technologies Private Limited is not bound to provide any notice of or reasons for any changes made to the Geocrat Platform or its content.
2. Geocrat Technologies Private Limited, its subsidiaries and initiatives hereby disclaim all warranties and conditions with regards to any information contained on this Geocrat Platform except such information as is provided specifically by Geocrat Technologies Private Limited, its subsidiaries and initiatives. Geocrat Technologies, its subsidiaries and initiatives assume no liability of any kind for the information and data on this Platform submitted by any of the users of this Platform nor is it responsible for the content of any other application/website linked to this Platform.
3. This Platform has security measures in place to protect the loss, misuse, and alteration of the information under our control. Unauthorized attempts to upload or change information (or otherwise cause damage to this Platform) are strictly prohibited and any such attempt will be dealt with strictly under law. Geocrat Technologies Private Limited is not responsible for damages of any kind arising out of the misuse of this Platform and shall have no liability to users for any delay, interruption or inability in accessing the Platform irrespective of the cause.
4. In order to provide our Services through our apps, services, features, software, or website, we need to obtain your agreement to our Terms of Service ("Terms").
B. About Our Services
1. Location based Services: We provide the location-based tracking services based of GPS enabled Devices to track the vehicles, assets, and other moving and stationary assets on Geocrat Platform. We may provide a convenient platform that enables you to receive the live information about your assets across our platform.
2. Enterprise Resource Planning Services: Geocrat ERP Platform will provide the services to manage inventory, assets, accounting etc. It will support you for automation for your backend operations and customers.
3. Software Development Services: Geocrat Provides the Software development services based on Web, Android & iOS Platform.
4. M2M Connectivity and iOT Services: Geocrat Provides the M2M Connectivity based on Telecom Operator with iOT Applications to digitalize the requirements.
5. Consulting Services: Geocrat Provides the Consulting services to Develop, Implement and Integrating the iOT Services to their IT Infrastructure & Network.
C. Terms of Service for the Geocrat Platform
1. These Terms of Service ("Terms") govern your access to and use of this Platform, including any other Application or Services of Geocrat Technologies Private Limited, its subsidiaries and initiatives, email notifications, applications, buttons, and widgets, and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Platform (collectively referred to as "Content"). Your access to and use of the Geocrat Platform is conditional on your acceptance of and compliance with these Terms. By accessing or using the Platform you agree to be bound by these Terms.
2. Account registration: To use the Service you must register or create a User account, providing all required data or information in a complete and truthful manner. Failure to do so will cause unavailability of the Service.
You are responsible for keeping their login credentials confidential and safe. For this reason, You are also required to choose passwords that meet the highest standards of strength permitted by this Application. By registering, you agree to be fully responsible for all activities that occur under their username and password. You are required to immediately and unambiguously inform the Geocrat Technologies Private Limited via the contact details indicated in this document, if they think their personal information, including but not limited to User accounts, access credentials or personal data, have been violated, unduly disclosed, or stolen.
3. You are informed during the purchasing process and before order submission, about any fees, taxes and costs (including, if any, delivery costs) that they will be charged.
4. Information related to accepted payment methods are made available during the purchasing process. Some payment methods may only be available subject to additional conditions or fees. In such cases related information can be found in the dedicated section of Geocrat Platform.
All payments are independently processed through third-party services. Therefore, Geocrat Platform does not collect any payment information, such as credit card details, but only receives a notification once the payment has been successfully completed.
If payment through the available methods fail or is refused by the payment service provider, the Geocrat Technologies Private Limited shall be under no obligation to fulfil the purchase order. Any possible costs or fees resulting from the failed or refused payment shall be borne by You.
5. Account termination: You can terminate your account and stop using the Service at any time by directly contacting the Geocrat Technologies Private Limited at the contact details provided in this document.
6. Account suspension and deletion: Geocrat Technologies Private Limited reserves the right, at its sole discretion, to suspend or delete at any time and without notice, User accounts which it deems inappropriate, offensive or in violation of these Terms.
The suspension or deletion of User accounts shall not entitle You to any claims for compensation, damages, or reimbursement. The suspension or deletion of accounts due to causes attributable to you, does not exempt you from paying any applicable fees or prices.
7. You are responsible for your use of the M2M Services, including use of Telecom SIM Card, for any misuse, and for any consequences thereof. Any Extra Charges due to misuse will be borne by you.
8. You are responsible for your use of the Geocrat Platform and Geocrat Services, for any Content you submit to the Geocrat Platform, and for any consequences thereof.
9. You may use the Geocrat Platform only if you are competent to contract under Indian contract laws and are not a person barred from receiving services under Indian laws or another applicable jurisdiction. If you are accepting these Terms and using the Geocrat Platform on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so. You may use the Geocrat Platform only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
10. The Geocrat Platform is constantly evolving, and the form and nature of the Geocrat Platform may change from time to time without prior notice to you. In addition, the Geocrat Platform may be disabled (permanently or temporarily) or any features or services within the Geocrat Platform may be disabled (permanently or temporarily) for you or for users generally or specifically and any prior notice of the same may not be given to you. Geocrat Technologies Private Limited also retains the right to create limits on use and storage at its sole discretion at any time without prior notice to you.
11. Any information that you provide on the Geocrat Platform is subject to our Privacy Policy, which governs our collection and use of your information. As part of providing you access to the Platform, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the services provided by the Geocrat Platform and your account on the Geocrat Platform, which you may not be able to opt-out from receiving.
12. You are responsible for safeguarding the password that you use to access the Geocrat Platform and for any activities or actions under your password. Geocrat Technologies Private Limited cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
13. Geocrat Technologies Private Limited accepts no responsibility for the content or correctness of content on this Geocrat Platform.
14. All content, whether publicly posted or privately transmitted, are the sole responsibility of the person who originated such content. We may not monitor or control the content posted via the Geocrat Platform or Services and, we cannot take responsibility for such content. Any use or reliance on any content or materials posted via the Geocrat Platform or obtained by you through the Geocrat Platform is at your own risk.
15. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications submitted on the Geocrat Platform or endorse any opinions expressed via the Platform. Under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Geocrat Platform.
16. You retain your rights to any information you submit, post or display on or through the Services. By submitting, posting or displaying Content on or through the Geocrat Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).
17. You agree that this license includes the right for Geocrat Technologies Private Limited to provide, promote, and improve the Geocrat Platform and to make Content submitted to or through the Geocrat Platform available to other companies, organizations or individuals who partner with Geocrat Technologies Private Limited for the syndication, broadcast, distribution, or publication of such Content on other media and services, subject to our terms and conditions for such Content use. Such additional uses by, Geocrat Technologies Private Limited or other companies, organizations or individuals who partner with Geocrat Technologies Private Limited may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Website.
18. We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.
19. Creating an account with the Geocrat Platform gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software that is provided to you as part of the Geocrat Platform. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Geocrat Platform based on Subscribed Plans & Services, in the manner permitted by these Terms.
20. All rights, title, and interest in and to the Geocrat Platform are and will remain the exclusive property of Geocrat Technologies Private Limited. The Geocrat Platform is protected by copyright, trademark, and other laws of both the India and foreign countries. Nothing in the Terms gives you a right to use the Geocrat Platform name or any of the Geocrat trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Geocrat, or the Geocrat Platform is entirely voluntary, and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.
21. Geocrat Technologies Private Limited respect the intellectual property rights of others and expect users of the Geocrat Platform to do the same. We will respond to notices of alleged copyright infringement that comply with the Indian Copyright Right laws and are submitted according to the procedure prescribed by such laws. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the details as prescribed by Indian Copyright laws so as to enable us to take requisite action as prescribed by such laws.
22. We reserve the right to remove Content alleged to be infringing / offensive without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, Geocrat Technologies Private Limited will also terminate a users account if the user is determined to be a repeat offender.
23. In the event of any dispute / complaint the user must address an e-mail to legal@geocrat.com. For any legal disputes, the user agrees that the courts in Delhi NCR shall have complete jurisdiction.
